AUCTION HELD AT:  FOSSIL CREEK HOTEL & SUITES, 1430 S. FOSSIL, RUSSELL, KS.  ADJACENT TO INTERSTATE 70 AND HIGHWAY 281. 

Land Location:  From Galatia, Kansas; East on NW 190 Rd. to NW 90 Ave. then South One half (1/2) mile to land location, one will be at the half section line (East side of road).  Auction Sign is posted.

Legal Description:  West Half of the Southwest Quarter (W/2 SW/4) of Section Twenty-five (25), Township Sixteen (16) South, Range Fifteen (15) West of the Sixth Principal Meridian of Barton County, Kansas.

General Description:  This 80 Acre tract less road ways has been occupied by the same tenant for 40 + years, excellent farming practice has been maintained with a no-till crop rotation program.  The present Land owner & Tenant agreement is a 1/3 – 2/3 for any investor interested.  The radio communications tower has been in place 35+ years, a 50 x 50 square or 2,500 sq. ft. (0.06 +/- acre) occupancy IWG II, LLC (Grantee).  Annual tower income is approximately  $2,200.00 paid annually with 2017 payment retained by the seller, any future payments and lease agreement to be conveyed to buyer at closing. (Tower lease agreement to be displayed at Auction) Soils:  Two types of soils are part of this tract; Crete silt loam which are 0 to 1 percent slopes along the West side of this tract and Harney silt loam, 1 to 3 percent slopes along the back side of the tract, all well drained soils, Harney being the Kansas state soil

Notes:

TERMS:  Ten (10) percent down day of sale, balance to be paid upon closing.  Payment by personal or corporate checks are acceptable for down payment with final payment to be in certified funds.  Bidding is not contingent upon financing therefore all finance arrangements must be completed before Auction.

EVIDENCE OF TITLE:  Seller will provide title insurance to Buyer(s) in the amount of the purchase price with the premium and escrow closing costs to be shared equally between Seller and Buyer.  Barton County Abstract & Title, 2010 Forest Ave., Great Bend, KS. will be escrow and closing agent.

CLOSING & POSSESSION:  Closing date shall be on or before December 8, 2017.  Possession on idle cropland is on day of closing, with the balance of the wheat crop to be taken after the 2018 wheat harvest.  Sellers 1/3 wheat  interest to be conveyed to the buyer.  2017 1/3 Milo crop retained by the seller.

TAXES: Seller shall pay taxes for 2017 and any prior years taxes. All Subsequent years taxes will be the responsibility of the Buyer(s).  Current annual taxes  are shown to be in the amount of $1,181.88. 

MINERALS:  All minerals are believed to be in tact and will convey with land to buyer(s). 

RADIO TOWER LEASE:  Seller to retain 2017 tower lease payment, all subsequent payments and lease contract to convey to Buyer(s).

ACREAGES:  Acreage figures are considered to be approximate based on (USDA) FSA records.
